NOTICE OF SALE UNDER POWER
GEORGIA, DODGE COUNTY
By virtue of the power of sale contained in the Deed to Secure Debt from DAVID COOPER TO MERCHANTS & CITIZENS BANK, dated March 4, 2005, recorded in Deed Book 506, pages 321-325, in the Office of the Clerk of Superior Court of Dodge County, Georgia, conveying the property described hereinafter to secure a Note in the original principal amount of $17,800.15, with interest thereon as set forth therein, for a total amount of $5,836.94 (as of November 26, 2014) being due, there will be sold at public outcry to the highest bidder for cash, before the Courthouse door of Dodge County, Eastman, Georgia, during the legal hours of sale on the FIRST TUESDAY IN JANUARY, 2015, the following described property, to-wit:
ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN ORIGINAL LAND LOT NO. 74 IN THE 14TH LAND DISTRICT OF DODGE COUNTY, GEORGIA, CONTAINING 2.45 ACRES, MORE OR LESS, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS, TO-WIT: TO LOCATE THE BEGINNING POINT, START AT THE INTERSECTION OF THE CENTERLINE OF MILAN-EASTMAN HIGHWAY (COUNTY ROAD #30) AND THE CENTERLINE OF ANTIOCH CHURCH ROAD (COUNTY ROAD #28), WHICH STARTING POINT IS THE WEST CORNER OF SAID LAND LOT NO. 74, AND FROM SAID STARTING POINT ALONG THE CENTERLINE OF ANTIOCH CHURCH ROAD NORTH 44 DEGREES 21 MINUTES 35 SECONDS EAST 1020.91 FEET; THENCE ALONG THE FENCE LINE SOUTH 46 DEGREES 00 MINUTES 00 SECONDS EAST 1140 FEET TO THE POINT OF BEGINNING OF THIS DESCRIPTION; AND FROM SAID BEGINNING POINT, AS ESTABLISHED, THENCE SOUTH 46 DEGREES 00 MINUTES 00 SECONDS EAST 520.00 FEET; THENCE SOUTH 35 DEGREES 00 MINUTES 00 SECONDS WEST 121.19 FEET; THENCE SOUTH 46 DEGREES 57 MINUTES 46 SECONDS EAST 160.00 FEET; THENCE SOUTH 44 DEGREES 32 MINUTES 27 SECONDS WEST 104.89 FEET; THENCE NORTH 46 DEGREES 54 MINUTES 18 SECONDS WEST 400.21 FEET;
THENCE NORTH 44 DEGREES 12 MINUTES 27 SECONDS EAST 104.48 FEET; THENCE NORTH 45 DEGREES 51 MINUTES 12 SECONDS WEST 297.10 FEET; THENCE NORTH 44 DEGREES 00 MINUTES 00 SECONDS EAST 123.00 FEET TO THE POINT OF BEGINNING, ALL AS MORE PARTICULARLY SET FORTH IN THAT CERTAIN PLAT OF SURVEY BY GRADY BONEY, G.R.L.S. #2460, DATED JUNE 1, 2000, AND RECORDED IN PLAT BOOK 30, PAGE 239, DODGE COUNTY RECORDS, SAID PLAT BEING INCORPORATED HEREIN AND MADE A PART HEREOF BY REFERENCE.
The debt secured by said Deed to Secure Debt has been and is hereby declared due because of non-payment of the indebtedness when due and in the manner provided in the Note and Deed to Secure Debt. The debt remaining in default, the sale will be made for the purpose of paying the same and all expenses of sale, as provided in the Deed to Secure Debt and by law, including attorney’s fees, notice of intent to collect attorney’s fee having been given.
Said property will be sold subject to any outstanding ad valorem taxes, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Deed to Secure Debt first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property is ESTATE OF DAVID COOPER, or a tenant or tenants, and said property commonly has an address of 3878 MILAN EASTMAN ROAD, MILAN, GA 31060.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Deed to Secure Debt.
