NOTICE OF SALE UNDER POWER IN SECURITY DEED
Under and by virtue of the power of sale contained in the security deed from FRANCES L. KING to CITIZENS BANK & TRUST COMPANY, dated March 13, 1998, and recorded in Deed Book 300, page 229, Dodge County Records, there will be sold by the undersigned at public outcry to the highest bidder before the Courthouse Door at Dodge County, Georgia, within the legal hours of sale, on the first Tuesday in April, 2016, the following described property:
THAT TRACT OR PARCEL OF LAND WITH DWELLING HOUSE THEREON LYING AND BEING IN THE CITY OF EASTMAN, DODGE COUNTY, GEORGIA, BEING A PORTION OF LOT 308 OF THE 16TH LAND DISTRICT OF SAID STATE AND COUNTY, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE NORTHWEST CORNER OF BEULAH STREET AND WARD STREET AND RUNNING THENCE IN A WESTERLY DIRECTION OF 160 FEET; THENCE IN A NORTHERLY DIRECTION 200 FEET, MORE OR LESS, TO AN ALLEY; THENCE IN AN EASTERLY DIRECTION ALONG SAID ALLEY 160 FEET TO WARD STREET; THENCE IN A SOUTHERLY DIRECTION ALONG WARD STREET 200 FEET, MORE OR LESS.
THERE IS EXPRESSLY EXCEPTED FROM THE ABOVE CONVEYANCE THAT CERTAIN PROPERTY DESCRIBED IN A WARRANTY DEED FROM ALBERT NOLES TO HENRY STYLE POWELL DATED JULY 2, 1958, AND RECORDED IN DEED BOOK 82, PAGE 538, IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF DODGE COUNTY, GEORGIA, SAID PROPERTY BEING DESCRIBED AS A LOT 75 FEET ON BEULAH STREET BY 200 FEET OF THE ABOVE DESCRIBED PROPERTY.
THERE IS ALSO EXPRESSLY EXCEPTED FROM THE ABOVE CONVEYANCE THAT CERTAIN PROPERTY DESCRIBED IN A WARRANTY DEED FROM ALBERT NOLES TO WHELM MARVIN NOLES DATED MAY 13, 1961, RECORDED IN DEED BOOK 90, PAGE 140, IN THE OFFICE OF THE CLERK OF SUPERIOR COURT OF DODGE COUNTY, GEORGIA, SAID PROPERTY BEING DESCRIBED AS A LOT 80 FEET ON WARD STREET EXTENDED BACK 85 FEET.
THE PROPERTY FIRST ABOVE DESCRIBED IS THE SAME PROPERTY AS THAT DESCRIBED IN A WARRANTY DEED FROM HERMAN WYNN TO ALBERT NOLES DATED JULY 5, 1947, AND RECORDED IN DEED BOOK 54, PAGE 482, DODGE COUNTY RECORDS, THE SAME BEING INCORPORATED HEREIN AND MADE A PART HEREOF BY REFERENCE,
SUBJECT TO EXISTING EASEMENTS FOR RIGHTS OF WAY, PUBLIC ROADS AND UTILITIES.
The debt secured by said security deed has been and is hereby declared due because of, among other possible events of default, failure to make payments in accordance with the terms of said note. The debt remaining in default, this sale will be made for the purpose of paying the same, and all expenses of sale, including attorney’s fees.
Said property will be sold subject to ad valorem taxes which are due or which are a lien; matters which might be disclosed by an accurate survey and inspection of the property; and any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the security deed being foreclosed.
