McLeod, Georgia Registered Land Surveyor, as found recorded in Plat Book 29, at Page 86 in the Deed Records of Dodge County, Georgia; said Plat being incorporated herein and made a part hereof by reference thereto.
Subject to that certain nonexclusive perpetual easement for ingress and egress to and from Dodge County Road No. 350B (also known as Bill Mullis Road) as shown on said Plat of Survey.
Subject also to a certain 15 foot non-exclusive easement of ingress and egress across the Southeast side of said tract of land as shown on said Plat of Survey.
Subject also to the following covenants and restrictions:
1) Any and all dogs must be maintained in a pen or on a leash and shall not be permitted to roam on adjoining properties.

Because of a default in the payment of the indebtedness secured by a Security Deed executed by Eschol Graham, III and Kristina Graham to Argent Mortgage Company, LLC dated February 11, 2005, and recorded in Deed Book 502, Page 1, Dodge County Records, said Security Deed having been last sold, assigned, transferred and conveyed to US Bank National Association, as Trustee for the Structured Asset Investment Loan Trust, 2005-7, by Assignment, securing a Note in the original principal amount of $117,000.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, September 7, 2010, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:
All that tract or parcel of land together with all improvements attached thereto lying and being in Land Lot 79, 20th Land District, Dodge County, Georgia, described as Lots 2 and 3 containing 2.00 acres, more or less, all as shown on that certain plat of survey prepared by John W. Dye, GRLS No. 940, recorded in Plat Book 22, Page 80, Dodge County Land Records. Said plat of survey and record thereof are by reference made a part hereof for a more accurate description of said property. ??This the same property conveyed by Derek Hutcheson to Eschol Graham, III and Kristina Graham dated December 29, 2004, recorded in Deed Book 497, Page 319, said records. Further, this is the same property conveyed by limited and special warranty deed from Wells Fargo Bank Minnesota, NA as Trustee for Delta Funding Home Equity Loan Trust 1999-1 to Derek Hutcheson dated August 6, 2003, recorded in Deed Book 449, Page 158, said records. Subject to: Easements, right-of-way, surveys, protective covenants, restrictions and limitations affecting said property of record, said records.
Said property is known as 193 Blackberry Drive, Eastman, GA 31023, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
Notice has been given of intention to collect attorney’s fees in accordance with the terms of the Note secured by said Deed.
Said property will be sold as the property of Eschol Graham, III and Kristina Graham, the property, to the best information, knowledge and belief of the undersigned, being presently in the possession of Eschol Graham, III and Kristina Graham, and the proceeds of said sale will be applied to the payment of said indebtedness and all the expenses of said sale, including attorney’s fees, all as provided in said Deed, and the balance, if any, will be distributed as provided by law.
