Subject to existing easements for public roads and utilities now in use.
Said deed was given to secure the payment of a promissory note in the principal sum of $45,528.00 as well as any other debts now owing or hereinafter incurred by RANDY C. JONES or his assigns, together with all extensions and renewals thereof in whole or in part whether evidenced by a new note, extension agreement or otherwise.
The said RANDY C. JONES having defaulted in the payments due on one or more of said note(s), BANK OF EASTMAN has declared the entire indebtedness secured by said deed to secure debt due and payable and the power of sale contained in said deed has become operative.
The undersigned, through its attorney at law, has given notice to bind the maker of said deed to secure debt and note for attorneys fees in the amount of Fifteen (15%) percent of the principal and interest all as provided for in said deed to secure debt and attorneys fees will be claimed.
The proceeds of sale will be applied first to the payment of all debts secured by said deed to secure debt, all unpaid taxes and assessments and expenses of sale, including attorney’s fees and the remainder, if any, will be paid to the person or persons legally entitled thereto.

Because of a default in the payment of the indebtedness secured by a Security Deed executed by Mitchell Kevin Holder and Kelly E. Holder to Union Planters Bank, N.A. EXHIBIT “A” All that tract or parcel of land lying and being in Land Lot 74 of the 15th Land District of Dodge County, Georgia, consisting of 6.93 acres, more or less, and more particularly described as follows: to find the beginning point, commence at the point of intersection formed by the land lot line of said Land Lot 74 with the northeastern right-of-way line of County Road 103, and from said point of intersection in a northwest direction along the northeast right-of-way line of said County Road 103 a distance of 1506.51 feet to a point, thence, in a direction of north 47 degrees 19 minutes east a distance of 150.98 feet to an iron pin being the place or point of beginning; from said point of beginning thus established, thence in a direction of north 47 degrees 19 minutes east a distance of 25.40 feet to an iron pin; thence in a direction of south 44 degrees 32 minutes 40 seconds east distance of 515.99 feet to an iron pin; thence in a direction of north 26 degrees 25 seconds east a distance of 673.23 feet to an iron pin on the south right-of-way line of the Golden Isles Parkway; thence along the south right-of way line of Golden Isles Parkway in a direction of north 82 degrees 18 minutes 55 seconds west a distance of 748.53 feet to lands of Lee and Betty Smith; thence along said Smith lands in a direction of south 05 degrees 54 minutes 50 seconds west a distance of 259.27 feet to an iron pin; thence along said Smith lands in a direction of south 43 degrees 46 minutes 50 seconds east a distance of 133.99 feet to the point of beginning; this parcel being further identified on a plat of survey prepared by Jim H. Ross, Dodge County surveyor, dated March 26, 1994, recorded in Plat Book 26, Page 149, Dodge County land records, said plat being incorporated herein for descriptive and all other legal purposes. Also conveyed is an easement 30 feet in width running from County Road No. 103 to above described point and place of beginning as shown on above-referenced plat of survey and as reserved by Michelle C. Woodard and James Gregory Woodard in a deed to Lee Smith and Betty Smith dated October 25, 1993, and recorded in Dodge County land records in Deed Book 236, Pages 761-762, said easement being for ingress and egress to above-described lands with the right to clear said easement.

NOTICE OF SALE UNDER POWER IN SECURITY DEED
Under and by virtue of the power of sale contained in the security deed from GREGORY MILES FRANKUM AND STEPHANIE FRANKUM to CITIZENS BANK & TRUST COMPANY, dated June 2, 2004, and recorded in Deed Book 476, page 5, Dodge County Records, there will be sold by the undersigned at public outcry to the highest bidder before the Courthouse Door at Dodge County, Georgia, within the legal hours of sale, on the first Tuesday in July, 2010, the following described property:
All that tract or parcel of land lying and being in the City of Eastman, Dodge County, Georgia, and being part of Lot of Land Number 10 in the 15th Land District of said State and County described as being all of Lots 3 and 4 in Block “L” of the Westbrook Survey of Fitzgerald Subdivision according to a plat thereof recorded in the Office of the Clerk of Dodge Superior Court I Deed Book 26, page 97, and by reference incorporated herein, and more particularly described in accordance with the plat of a survey thereof made by Jim H. Ross, in September 1964, which is recorded in Plat Book 6, page 116, and by reference incorporated herein, and being further described as follows: BEGIN on the Southeast side of Twelfth Avenue (formerly known as Eleventh Avenue and identified as such in the Westbrook Survey above referred to) which is 200 feet Northeast of the East corner of the intersection of Twelfth Avenue and Creighton Street and run thence South 44 degrees East 140 feet to a point; thence North 46 degrees East 100 feet to a point; thence North 44 degrees West 140 feet to Twelfth Avenue; thence along said Twelfth Avenue South 46 degrees West 100 feet to the point of beginning, subject to easements for streets and utilities.

The debt secured by said security deed has been and is hereby declared due because of, among other possible events of default, failure to make payments in accordance with the terms of said note. The debt remaining in default, this sale will be made for the purpose of paying the same, and all expenses of sale, including attor-
