Judge dismisses charges in federal lawsuit

Nicely, on behalf of “Jane Doe”, filed the lawsuit after then Dodge County High School Teacher/Coach Adrian Green pled guilty to statutory rape in Dodge Superior Court. On October 27, 2006 Green admitted to having sex with a 15-year-old student in a locker room in 2005. In the plea agreement, Green was to serve 360 to 365 days in a detention center and 10 years of intensive probation.
The 13 count federal lawsuit named the Dodge County School System, Aubrey Corbitt, Susan Long, Printis Thomas, Wayne Smith, Claude Godfrey, Shirley Ikedionwu, Jackie Tripp, Doug Martin, Rockey Stuckey, Stuart Rogers, Todd Giddens and Michelle Wall along with Adrian B. Green, the Bibb County School District and (Bibb County) superintendent Sharon Patterson.
The law suit claimed that the above individuals named in the suit deprived the plaintiff of her bodily integrity, had actual notice of Green’s sexual harassment of other students prior to the incident at DCHS, failed to adequately supervise Green in order to ensure the safety of the students, showed negligence in the hiring of Green in 2002 by contradicting their own hiring policy and other claims relating to Green and the Bibb County School District.
The Dodge County defendants requested a summary judgment on all the claims made against them. The order signed by Judge Bowen stated, “The court can grant a summary judgment only if ‘there is no genuine issue as to any material fact and the party who makes the motion is entitled to a judgment as a matter of law.’ The purpose of a summary judgment rule is to dispose of unsupported claims or defenses which, as a matter of law, raise no genuine issues of material fact suitable for trail.”
In the 32-page order, Judge Bowen recounts the incident between Green and “Jane Doe” and the action taken before the Dodge County School Board hired Green until the resignation of Green in 2005.
Judge Bowen dismissed all claims against the Dodge County School System, past and present employees and school board members.
