Under and by virtue of the power of sale contained in the security deed from RANDALL CHARLES CARR to CITIZENS BANK & TRUST COMPANY, dated April 12, 2004, and recorded in Deed Book 472, page 42, Dodge County Records, there will be sold by the undersigned at public outcry to the highest bidder before the Courthouse Door at Dodge County,
Georgia, within the legal hours of sale, on the first Tuesday in December, 2011, the following described property:
TRACT I: All that tract or parcel of land containing 3.00 acres, more or less, lying and being in Land Lot No. 277 in the 19th Land District of Dodge County, Georgia, being more particularly described according to a Plat of Survey prepared by W. P. Johnson, Georgia Registered Land Surveyor #1713, dated August 6, 2002, and recorded in the Office of the Clerk of Dodge Superior Court in Plat Book 32, Page 224, said plat and the recording thereof being incorporated herein and made a part hereof by reference for descriptive and all other legal purposes. Said property being Tract #8 on said plat of survey.
Said property is conveyed with and subject to that certain ingress/egress easement depicted on the above referenced plat of survey.
TRACT II: All that tract or parcel of land containing 1.20 acres, more or less, lying and being in Land Lot No. 277 in the 19th Land District of Dodge County, Georgia, and being more particularly described according to a Plat of Survey prepared by W. P. Johnson, Georgia Registered Land Surveyor No. 1713, dated August 13, 2002, and recorded in the Office of the Clerk of Dodge Superior Court in Plat Book 33, page 22, said plat and the recording thereof being incorporated herein and made a part hereof by reference for descriptive and all other legal purposes. Said property being Tract #3 on said plat of survey.
Said property is conveyed with and subject to that certain ingress/egress easement depicted on the above referenced plat of survey.
The above referenced tracts are subject to the following restrictions: The property shall be used for single-family residential purposes only. Property is to contain one dwelling and may not be subdivided by owner. All structures or homes located on property must be placed at least 40 feet from property lines adjoining roads and at least 20 feet from other property lines. Mobile homes must be underpinned. No discarded or inoperable vehicles may be kept on property. No livestock operations can be kept on property. Property will be conveyed with the following rights and obligations regarding use of nearby pond.
1. The owners and immediate family residing within the owners household shall have the right to use the entire surface area of the pond shown on said plat for recreational purposes only. Said right to use the surface area shall not authorize or permit owners to enter or go upon the lands of others surrounding the pond. Together with a right of ingress and egress to and from said pond along the easement set forth in said plats.
2. The owners shall share equally in any cost or expense in the maintenance of the dam and pond cannot be altered or drained with the consent of all owners having rights to use said pond.
The debt secured by said security deed has been and is hereby declared due because of, among other possible events of default, failure to make payments in accordance with the terms of said note. The debt remaining in default, this sale will be made for the purpose of paying the same, and all expenses of sale, including attorney’s fees.
Said property will be sold subject to ad valorem taxes which are due or which are a lien; matters which might be disclosed by an accurate survey and inspection of the property; and any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the security deed being foreclosed.

Said Deed to Secure Debt having been given to secure a note dated March 6, 2007 in the original principal amount of $922,477.50 with interest from date at the rate as specified therein.
The debt secured by said Deed to Secure Debt has been and is hereby declared due because of among other possible events of default, failure to pay in accordance with the terms of said notes. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of the sale, including attorney(s) fees.
