Because of a default in the payment of the indebtedness secured by a Security Deed executed by SCOTT ANDERSON AND KAREN ANDERSON to THE CITIZENS BANK OF COCHRAN dated August 24, 2005, and recorded in Deed Book 341, Page 174, Dodge County Records, said Security Deed having been last sold, assigned, transferred and conveyed to WELLS FARGO BANK, N.A., AS TRUSTEE OF THE SECURITY NATIONAL MORTGAGE LOAN TRUST 2005-2, BY ASSIGNMENT, securing a Note in the original principal amount of $130,461.48, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, October 4, 2011, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:

East a distance of 736.69 feet to a concrete marker; thence run North 38 degrees 07 minutes 46 seconds East a distance of 417.26 feet to an iron pin; then run South 28 degrees 04 minutes 56 seconds East a distance of 504.65 feet to an iron pin; then run South 08 degrees 47 minutes 29 seconds East a distance of 196.93 feet to an iron pin; then run South 11 degrees 47 minutes 45 seconds East a distance of 83.59 feet to an iron pin; then run South 09 degrees 24 minutes 45 seconds West a distance of 139.83 feet to an iron pin; then run South 13 degrees 57 minutes 00 seconds East a distance of 121.93 feet to an iron pin; then run South 29 degrees 37 minutes 20 seconds East a distance of 189.13 feet to an iron pin; then run South 44 degrees 32 minutes 14 seconds West a distance of 134.64 feet to an iron pin set on the northeasterly right of way line of County Road No. 355 ( New Union Church Road); then run along said road South 68 degrees 52 minutes 51 seconds West a distance of 197.78 feet to an iron pin; then run South 70 degrees 09 minutes 03 seconds West a distance of 371.02 feet to an iron pin; then run South 72 degrees 17 minutes 29 seconds West a distance of 170.49 feet to an iron pin; then leaving said right of way, run North 43 degrees 28 minutes 33 seconds West a distance of 955.11 feet to the point of beginning. Said tract or parcel of land contains 22.985 acres of land, more or less. Said tract is further described as Tract B-1 according to that certain plat of survey prepared by J. B. Faircloth and Associates for Souter Brothers, dated June 9, 1997, and recorded in Plat Book 28, Page 232, Dodge County Land Records. Said plat is incorporated by reference herein for descriptive and all other legal purposes.??
Tract II: All that tract or parcel of land lying and being in Land Lot No. 122 of the 16th Land District of Dodge County, Georgia, and being Tract B-2 of 21.933 acres as more fully shown on plat of survey for Souter Brothers by J.B. Faircloth & Associates, R.L.S. No. 2120, dated June 9, 1997, File No. 1414A, and a copy of which is recorded in Plat Book 28, Page 232, in the Office of the Clerk of the Superior Court of Dodge County, Georgia. Said plat and recorded copy thereof is incorporated herein by reference for all purposes. This is a portion of that property as set out in a Warranty Deed from Russell Weaver to J. Lester Souter, III and William Hood Souter d/b/a Souter Brothers, a Georgia General Partnership, dated January 29, 1997, and recorded in Deed Book 278, Page 348, in the Office of the Clerk of the Superior Court of Dodge County, Georgia.
Said property is known as 403 FOUNTAIN ROAD, EASTMAN, GA 31023, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
Notice has been given of intention to collect attorney’s fees in accordance with the terms of the Note secured by said Deed.
Said property will be sold as the property of SCOTT ANDERSON AND KAREN ANDERSON, the property, to the best information, knowledge and belief of the undersigned, being presently in the possession of SCOTT ANDERSON AND KAREN ANDERSON, and the proceeds of said sale will be applied to the payment of said indebtedness and all the expenses of said sale, including attorney’s fees, all as provided in said Deed, and the balance, if any, will be distributed as provided by law.
